Common Mistakes Among Long-Term Care Employers
Grant Pecor, JD, Clark Hill PLC

This session will provide an opportunity to learn from the mistakes of others. In doing so, the session will cover some of the more common errors employers make related to their employees, including wage and hour issues, union bargaining laws, and leave obligations. Discussion will include recent investigations by the DOL on meal break policies resulting in hefty settlements.

Walk the Line: Establishing Appropriate Social Media Policies to Protect Residents, Employees & the Facility
Terry Bonnette, JD, MS, Nemeth Law

PCCMS has instructed State Survey Agency Directors to survey nursing home policies and procedures related to prohibiting staff from taking or using photographs and recordings in a manner that would demean or humiliate residents -- including posting on social media. The NLRB has taken the position that employees have the right to engage in concerted activity which sometimes extends to documenting workplace issues and posting them on social media. Where is the line between the resident’s right to privacy and freedom from abuse and the employee’s right to engage in protected activity? This session will help to define that line and identify best practices for developing social media/technology use policies that balance those rights.

Who Has the Authority? Advance Directives, Guardianships, and Conservatorships Demystified
Margaret Chamberlain, JD, Rolf Goffman Martin Lang LLP

Advance Directives, Guardianships, Conservatorships, Oh My! What direction to go and what do each of these entail? Providers need to understand who can make which decisions for their residents, what decisions can be made, and when they can make them. Margaret Chamberlain will share insights and guidance on legal authority for decision making along with implementing Advance Care Planning.

Professional Licensing Investigations: What You Need to Know to Survive
Margaret Chamberlain, JD, Rolf Goffman Martin Lang LLP

With the recent increase in professional licensing investigations, it is imperative that nursing home administrators and other health professionals understand how these investigations start, how the process works, the professional’s rights throughout the process, along with the potential consequences of an investigation.

When the Attorney General Comes Knocking...Vulnerable Adult Abuse
Andy Rothman, JD, Lebenbom & Rothman PC

The prevention and prosecution of abuse committed against vulnerable adults is one of the goals of Michigan’s Attorney General. We all have seen the press releases as nursing assistants are being charged with 4th degree abuse after failing to follow the care plan. Some are investigated by the bureau; others by the AG’s office. So what should you do when you hear them knocking? Learn how to effectively answer their questions while protecting what is truly Quality Assurance and your employees.

Sam is Coming for You! What Do Facilities Get Sued For and What To Do About It
David Wiegel, JD, Kitch Drutchas Wagner Valitutti & Sherbrook

Long-term care providers continue to face frequent lawsuits by residents and their families. What do facilities get sued for the most? Can anything be done to reduce the chances of this happening or lessen the severity of a lawsuit? What does a facility do if served with a lawsuit? What steps does a facility need to take afterwards? Join David Wiegel in this enlightening session to learn common issues that are the subject of lawsuits, steps to lessen the severity of a lawsuit, and what to do if you get sued!

What Every SNF Needs to Know About Compliance
Margaret Chamberlain, JD, Rolf Goffman Martin Lang LLP

While compliance programs in skilled nursing facilities have been around for quite awhile, they will now be required in Phase 3 of the Requirements of Participation. It is critical for facilities to understand how to integrate compliance programs into their operations without eroding privileges afforded by state and federal laws.
